Terms of Service

Welcome to Lava ("Company," "we," "us," or "our"). By accessing or using our website at lavawish.com or our web application at app.lavawish.com (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

2. Description of Service

Lava is a subscription-based reminder service that enables users to track recurring life events (such as birthdays and anniversaries) and receive automated email reminders in advance of those events. Features include custom reminder scheduling, event tagging, and curated holiday calendar collections.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@lavawish.com of any unauthorized use of your account.

4. Subscription, Billing & Pricing

Lava offers a subscription plan billed at $12 per year (equivalent to $1/month). Your subscription automatically renews each year unless you cancel before the renewal date.

We reserve the right to change our pricing at any time. Any price changes will be communicated to you in advance and will take effect at your next renewal date.

All payments are processed securely through third-party payment processors. Lava does not store your payment card information.

5. Lifetime Access — Definition & Limitations

From time to time, Lava may offer a "Lifetime" access plan (including via promotional codes such as "LIFETIME"). The following terms apply specifically to any Lifetime plan:

• "Lifetime" means the operational lifetime of Lava as a company and service. Access granted under a Lifetime plan entitles you to use the Service for as long as Lava continues to operate and offer the Service, subject to these Terms.
• If Lava ceases operations, is acquired, merges with another entity, or discontinues the Service for any reason, your Lifetime access will terminate at that time. Lava shall have no obligation to provide a refund, credit, or alternative service in such an event, except as required by applicable law.
• A Lifetime plan does not guarantee access to any specific features, integrations, or third-party services. Features may be added, modified, or removed at our sole discretion.
• Lifetime access is personal to you and is non-transferable and non-refundable after the 14-day refund window described in Section 6.
• Lava reserves the right to terminate a Lifetime account for violation of these Terms without any obligation to refund.

6. Refund Policy

We offer a 14-day money-back guarantee for all new purchases, including Lifetime plans. If you are not satisfied with the Service for any reason, you may request a full refund within 14 calendar days of your initial purchase date by contacting us at hello@lavawish.com.

No refunds will be issued after the 14-day period. This applies to both annual subscriptions and Lifetime plans.

Refunds are issued to the original payment method within 5–10 business days. We reserve the right to deny refund requests that show evidence of abuse of this policy (e.g., repeated purchases and refunds).

7. Cancellation

You may cancel your annual subscription at any time through your account settings. Upon cancellation, your access will continue until the end of your current billing period. No partial refunds are provided for unused time within a billing period, except as covered by the 14-day refund policy above.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload or transmit any content that is harmful, abusive, harassing, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use automated means (bots, scrapers) to access or interact with the Service.

9. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, and software—are owned by Lava or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LAVA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO LAVA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lava and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms.
